Dear Sir:

Thank you for your response letter dated October 2, 1996 in which you denied my request on the basis of FOIA exemptions (b)(1) and (b)(3).

I appeal this decision to the CIA Information Review Committee, in your care. The basis of my appeal is as follows:

1. I only request material which is already declassified, either because your Agency made such a determination on its own, or because the material becomes automatically declassified when it reaches 20 years old. As such, the record I request, which dated prior to 1976, is not covered by exemption (b)(1).

2. I am only interested in obtaining information on my brother and have no intention in knowing "intelligence sources and methods, as well as the organization, functions, names, official titles, salaries or numbers of personnel employed by the Agency". I deem your Agency is capable of providing me with a record which contains all the precautionary deletions.
